Marketing innovations are not rare in the modern world, as evidenced by the success of Wal-Mart, which found a more efficient and profitable way to distribute goods and services than the status quo, providing lasting value to stockholders, employees, distributors, and consumers
But how exactly does this happen, and must it always? Doomed by Design? The first question is this: Is any company choosing this marketing strategy destined to fail, to degenerate into an exploitative venture, regardless of how good the product is? To see this clearly we must go through an, otherwise, obvious and elementary discussion of how any business must be careful not to overhire, overextend, or oversupply a market
the Real World The basic question that needs to be asked is this: If this product or service is so great, then why isn't it being sold through the customary marketing system that has served human society for thousands of years? Why does it need to resort to a 'special marketing' scheme like an MLM? Why does everyone need to be so inexperienced at marketing this! Is the product just a thin cover for what is really a pyramid scheme of exploiting others? But more on that later

Multilevel marketing plans usually promise to pay commissions through two or more levels of recruits, known as the distributor's "downline." If a plan offers to pay commissions for recruiting new distributors, watch out! Most states outlaw this practice, which is known as "pyramiding." State laws against pyramiding say that a multilevel marketing plan should only pay commissions for retail sales of goods or services, not for recruiting new distributors
The Federal Trade Commission cannot tell you whether a particular multilevel marketing plan is legal

For Release : August 9, 2001 Bigsmart Pyramid Promoters Settle FTC Charges Two Promoters Barred for Life from Future Multi-Level Marketing Plans Three operators of an Internet-based business opportunity that promised easy income for investors in an Internet shopping mall network have agreed to settle Federal Trade Commission charges that their scheme was an illegal pyramid operation
The settlement permanently bars two of the promoters, Darrin Epps and Edward Lamont, from participating in multi-level marketing schemes
A third defendant, Richard Slaback, is barred from participation in multi-level marketing schemes for seven years
Slaback also is barred from participating in any multi-level marketing enterprise for seven years
Because of the egregiousness of their recruiting practices in this case and their prior involvement with unlawful multi-level marketers, however, the orders bar Epps and Lamont from participating in any multi-level marketing enterprise for life

In July 1999, the National Association of Attorneys General announced that complaints about multilevel marketing and pyramid schemes were tenth on their list of consumer complaints
Amway's 1998 "Business Review" tabulates figures gathered from April 1994 through March 1995 from distributors who attempted to make a retail sale, presented the Sales and Marketing Plan, received bonus money, or attended a company or distributor meeting in the month surveyed
